GW claims they own the term 'Space Marine'

The TL;DR of it is, GW sent cease and desist letters to a fiction author and had Amazon pull the eBook from their site, because it has the term, 'Space Marine,' in the title. Strange stuff.

They have done it before. They did it last year if I remember. This is nothing new for them. Legal department swinging what they think is a big hammer.

After reading this I have decided that the movie "Pineaple Express" should redo one of its quotes from:

"But if you do something heroic then you'll come back as like an eagle or a dragon, or Jude Law."

    To:

"But if you do something heroic then you'll come back as like an eagle or a dragon, or Nick Rose."

I don't usually keep up with this sort of legal shenanigans, but has GW sued Blizzard over, 'Space Marines,' used in StarCraft? Or is it only when it's in the title of something that they throw out C&D letters? Just seems odd as the term has been in use in Sci-fi for decades, with the earliest published form from the 1930s, I believe, with E. E. Smith's Lensman series.

I am sure they have sent C&D letters but they have never sued. They would never win. This is them bullying low end and small time shops because they can't fight back.

Blizzard has enough common sense to ignore them where Amazon looks at as a legal risk.

If he hosted this himself on an American server he could in effect give GW the middle finger. The onus probandi is on GW not him and they will loose every time in the US. This is why they bully but do nothing further. Hell I would defend myself, try to get the venue moved to a state where plaintiffs get the privilege of paying the defendants costs if they loose, and then tell GW to Eggo off.

Does anybody else find it odd, by the way, that the information age has led to language becoming an oblique and imprecise tool where even the most straightforward phrasing is pored over with chicken entrails and bone tossing to divine the true meaning?

Looks like the Electronic Frontier Foundation is lending the author a hand. They recommended a couple lawyers who might take the case pro-bono and help her give GW that middle finger.

Awesome. GW is going to kill their own IP by being a bully.

Yeah, they're definitely not doing their brand any favors. The other forums I frequent are discussing this and are full of posts with people saying something along the lines of, "every time I get interested in buying some Warhammer, GW does something like this."

Problem is those people were never going to buy to begin with so GW doesn't care about them.

For once I agree with, Nick.
